The General Terms below are complicated legal terms that serve to protect us and make it clear the privacy terms that will apply to users of Joystic services. These terms below are here to give you a simple explanation of what the General Terms mean in plain English. However, these plain English terms are not legally binding, and the General Terms are still the legal terms that will apply if anything goes wrong.
Personal Information: Joystic stores your personal information when you use our App. Because we keep this information, Joystic takes on the legal responsibilities that come with storing information.
Sharing Personal Information: In order to successfully deliver Joystic's service, we may share your personal information with our suppliers. If any information is disclosed by Joystic to a third party, this will be disclosed in a way that is anonymous, in that you cannot be personally identified.
Your Rights: You have rights to be able to access, amend and delete your personal information.
Log data: When you visit our App, Joystic collects data that your browser sends to us. This includes IP address, browser version, time and date of visit, and other statistics.
Cookies: Our App uses cookies to collect data and improve itself. You can either accept or refuse these cookies and know when it is being sent to you. If you refuse, you might not be able to use some parts of our App.
Security: Joystic uses a highly secure cloud service to protect your data in the form of a secure sockets layer (SSL) for web and app traffic. All passwords are protected by salted PBKDF2 hash encryption.
Third-party Links: When you click on a third-party link to another site that is not operated by us, we have no control over or responsibility for the content or privacy policies of these other sites.
Joystic Tourism Pty Ltd (a limited company incorporated in Australia) (ABN 73 661 634 019) (Joystic) operates the Joystic mobile app (App) and www.joystic.com (Website). Collectively, the App and Website allows for travellers to reserve places at selected accommodation and activity providers (for example skydiving and bungy jumping) via the App (Service).
This privacy policy is used to inform you of Joystic’s policies relating to the use and disclosure of Personal Information when you use our Service. When we talk about Personal Information, we mean information relating to you or other identifiable individuals.
By using the Service, you agree to be bound by the terms of the then current privacy policy (Privacy Policy). Joystic reserves the right, at any time, to modify or replace the Privacy Policy. The most recent version of the Privacy Policy is available at www.joystic.com/privacy. Please check the Privacy Policy page periodically for changes, though we will also notify you via the App of any changes that, in our sole discretion, materially impact your use of the App or the treatment of your Personal Information. Your use of the App following the posting of any changes to the Privacy Policy constitutes acceptance of those changes.
The terms used in this Privacy Policy have the same meanings as in our Terms of Service, (which is accessible via the App) unless otherwise defined in this Privacy Policy.
The Personal Information we collect about you, with your consent, may include, but is not limited to: your name, age, email address, postal address, phone number, billing information, survey responses, booking details and other information you may provide about yourself to our App, and your IP address.
We collect and process Personal information in different ways. We collect Personal Information you give us directly, but we also collect data by logging how you interact with our App and the Service.
When you book via the App using our Service for someone else on Joystic, you will need to submit that individual's Personal Information. You must obtain the consent of other individuals prior to providing us with their Personal Information. If another Joystic member grants you access to their data via a shared booking, or other similar service, you should treat that information appropriately.
We also may periodically obtain information about you from Activity Providers, operators, business partners and other independent third-party sources and add it to other information about you. For example, if you log into the App via a third-party service, we may collect information such as your username and other information made available to us through those services in accordance with the referring third party's privacy policy.
We automatically collect some information from your device when you use the App. For example, we collect your session data, including your IP address, the navigation software used and the reference site. We may collect information about your online activity, such as reviewed content, pages visited and searches. We automatically collect this type of information to try to better understand your interests and preferences and to better personalise your experience. We also collect Personal Information to help protect Joystic and other users from misuse.
When you use our Service on your device, through the App, we may collect certain information about your location if you have instructed your device to send such information to the App via the privacy settings on that device. For example, we may use your location to show you activities/accommodation near you when you are travelling. You can change the privacy settings on your device at any time to turn off the functionality to share location information with the App. Please note that turning off location sharing may affect certain features of our App.
The Service allows you to search and book activities and accommodation in your local area. Joystic cannot take responsibility for the content or privacy policies of any Third-Party Apps. Please ensure you read and understand the privacy policies of any Third-Party App accessed by you via the Service.
Joystic uses your Personal Information for the following general purposes:
We also use non-identifiable information gathered for statistical purposes to keep track of the number of visits to the Service with a view to introducing improvements and improving usability of the Service. We may share this type of anonymised statistical data so that our partners also understand how often people use the Service, so that they, too, may provide you with an optimal experience.
We want to make it easy for you to take advantage of travel and activity related opportunities on our App. One way we do this is by sending you messages via the App and/or by email that contain information about your travel/activity related interest. We believe that these emails will provide you with useful information about travel/activity special offers available on our App. You have the option to change the types of emails you receive or unsubscribe from these emails at any time in the App.
You will receive marketing messages from us if you have given your consent, if you have requested or if you use the Service to access products or experiences from us and if you have not opted out of receiving marketing messages.
When you provide a booking/tour operator with your Personal Information details via the App, Joystic will in turn share this information with the Supplier (activity/accommodation provider) to supply you with the Service.
Due to operational requirements, Joystic may be required to share your Personal Information with a Supplier in certain events, however these events are limited to a cancellation or to contact you in the instance of failing to reconfirm dietary requirements. You consent to this Personal Information being shared with the relevant Supplier in such circumstances.
We may use your Personal Information, either individually, in the aggregate, and/or combined with demographic information that we maintain or collect from third parties for marketing and advertising purposes. However, such information will always be displayed in an anonymised way so that you personally cannot be identified.
We may disclose anonymised information to companies affiliated with Joystic and/or unaffiliated third parties: (i) to provide the products and services you have requested; and(ii) for administrative, analytical, and marketing purposes.
Subject to obligations consistent with this Privacy Policy, we may also disclose information to our affiliates, agents, contractors, and service providers in order to facilitate the functioning of the Service or to perform tasks that are integral to the Service, such as making bookings, processing transactions, fulfilling requests for information, or providing support services or other tasks, from time to time.
In addition, from time to time, we may share your Personal Information with certain third-party companies with which Joystic has a business relationship. These companies may send you offers based on the information you have provided us. Where we are required by applicable law, we will seek your consent prior to sharing your Personal Information with such third parties for marketing purposes. Also, you can opt out of having your information shared with third parties for those parties' direct marketing purposes by emailing us at hello@joystic.com or via the App.
If we sell or divest our business or any part of it, and your Personal Information relates to such sold or divested part of our business, or if we merge with another business, we will share your Personal Information with the new owner of the business or our merge partner, respectively.
If we are legally obliged to do so, we will share Personal Information to protect our customers, the App, as well as our company, rights and property.
Other than set out above, you will be notified when Personal Information about you will be shared with third parties, and you will have an opportunity to choose not to have us share such information.
Joystic is an Australian company with its head-office located in Gold Coast, Australia, and which operates in Australia only. Your data will be held in Australia.
Joystic uses third-party service providers (such as managed hosting providers, card processors, CRM systems, and technology partners) to provide the necessary hardware, software, networking, storage and other services that we use to operate the Service.
By using the Service or submitting any Personal Information to Joystic via the Service, you consent to Joystic and its authorized service partners using your Personal Information in Australia to make the Service available to you.
We will only retain your Personal Information for as long as necessary to fulfil the purposes we collected it for, including the purposes of satisfying any legal, accounting or statutory reporting requirements.
In order to determine the appropriate retention period for Personal Information, we consider the following factors; the amount, nature and sensitivity of the data, potential risk of harm from unauthorised use or disclosure, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means.
We may retain certain information subsequent to the termination of your account, for example if it is necessary to fulfil our legal obligations or to exercise, to maintain security, to prevent fraud and abuse and to defend or enforce our rights. If you choose to terminate your account, your Personal Information will be removed within 365 days.

You can check, supplement and update the information you have provided by accessing your "Settings" section of your account on the App. You may also terminate your Joystic account by using the methods provided below.
If you decide to terminate your account, we will deactivate it, and remove your Personal Information. Remember that once your account is closed, you will no longer be able to login and access your Personal Information. You can however, open a new account at any time.
We may offer users the option to save information related to method and choice of payment on our App. If you save such payment details in your account on Joystic, you will be able to add, delete or modify that information at any time during which your account remains open in account settings. You also have the option of changing your marketing preferences at any time your account remains open via account settings.
You have the following rights with regard to your Personal Information:
You can exercise several of your rights through the Personal Information section of your account. To exercise your other rights, you can file a request by email to hello@joystic.com.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. In an effort to speed up our response, we may also contact you to ask you for further information in relation to your request.
Whenever you visit our Service, Joystic collects information that your browser sends to us that is called Log Data. This Log Data may include information such as your computer’s Internet Protocol (IP) address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
Cookies are files with small amounts of data that is commonly used as an anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your computer’s hard drive.

Therefore, we strongly advise you to review the Privacy Policy of these websites.
